The president of the TSE (Superior Electoral Court), minister Kássio Nunes Marques, created a permanent commission to discuss and monitor the use of AI (Artificial Intelligence) tools by the Electoral Court.


The measure was made official in an ordinance published this Tuesday (9). According to the document, the group will be responsible for developing a plan to guide the use of technology in both administrative activities and trials conducted by the Electoral Court.


The commission's main duties will be to propose measures to combat misinformation and the spread of fake news, one of the main challenges faced by electoral authorities in recent years.


The board must also develop guidelines to ensure that Artificial Intelligence tools are used in a safe, transparent manner and in accordance with ethical principles. It will also be up to the group to define criteria for the hiring, acquisition and development of these technologies by Electoral Justice bodies.


Another task of the commission will be to create standards for integration and sharing of systems between electoral courts, in addition to maintaining a national registry of Artificial Intelligence solutions developed or used by the Electoral Court.


Also in accordance with the ordinance, the commission will also monitor partnerships signed with universities and institutions specializing in Artificial Intelligence to expand the technical capacity of the Electoral Court to identify and combat crimes committed in the digital environment.

Challenge of AI
When assuming the presidency of the TSE last month, minister Kássio Nunes Marques cited Artificial Intelligence as one of the main challenges for the 2026 elections. According to him, the electoral process has become strongly impacted by the digital environment and technological platforms.


Since last year, the TSE has started to conduct studies and initiatives to anticipate risks related to the use of AI, especially after the dissemination of hyper-realistic videos.


In 2024, during municipal elections, the Court regulated for the first time the use of Artificial Intelligence in electoral propaganda, prohibiting deepfakes. The publication of manipulated content to disseminate false or out-of-contextual facts with the potential to affect the balance of the electoral dispute was also prohibited.


For this year's election, under the rapporteur of Nunes Marques, the rules were expanded: the publication, republication and boosting of content produced or altered by AI in the 72 hours before the vote and in the 24 hours after its closing was prohibited.


The use of AI in posts must also be flagged.
