Zambelli has to leave Interpol list after Italian decision, says defense
The Italian court released, last Thursday (11), the decision that denied the extradition of Carla Zambelli. After the publication of the document, Zambelli's lawyer stated that she should be removed from the Interpol list. The former deputy's legal situation, however, remains cloudy.
According to political analyst Pedro Venceslau, lawyer Fábio Pagnozzi declared that a new stage is now beginning from a legal point of view.
"He still can't really understand what Carla Zambelli's situation is like with regard to Interpol's red spread", Venceslau reported to CNN 360º this Friday (12). Names included in Interpol's red broadcast are prevented from traveling at international airports, and may result in arrest.
According to information gathered by Venceslau from Public Security analyst Elijonas Maia, when a person is arrested, their name is removed from the red broadcast. "The issue is that the name may return to the Interpol list if there is a request from the Brazilian Federal Police or the Brazilian government", highlighted Venceslau.
Lawyer Fábio Pagnozzi informed that he intends to request help from the Italian government to communicate with Interpol and the police authorities, in order to understand precisely what Zambelli's legal situation is and whether she is free to travel around the European Union.
"Evidently she cannot set foot in Brazil at the moment, because there is an arrest warrant against her. Whether she can leave Italy, that is another question that needs to be answered", said the analyst.
Carla Zambelli fled Brazil after being sentenced to 10 years in prison for breaking into the National Justice Council (CNJ) system. Later, she was also convicted of illegal possession of a weapon and threatening, in an episode that occurred in São Paulo on the eve of an election. Regarding this second conviction, there is another extradition process underway in Italy.
Italian decision
The decision of the Italian Supreme Court, taken on May 22 and made public this Friday, indicated that there was a violation of the right to a fair trial in the process conducted in Brazil.
The document states that Alexandre de Moraes, rapporteur of the case, accumulated functions by being simultaneously the victim of one of the crimes accused of Zambelli and a member of the judging panel. This circumstance, according to the Italian court, would have compromised the impartiality of the process.
In response, the president of the STF Edson Fachin signed a note in defense of the First Panel of the Court, responsible for the trial. He stated that the process took place in accordance with the Brazilian Federal Constitution, with the right to full defense.
