The Road and Transport Committee of the Chamber of Deputies approved a bill that eliminates the application of points on the National Driving License (CNH) for drivers who park illegally in paid rotating parking spaces, the so-called "Blue Zone".

Currently, leaving the vehicle in violation of the Blue Zone's signaling rules - such as forgetting to activate the digital ticket or exceeding the regulated time - is considered a serious infraction by the Brazilian Traffic Code (CTB). Current punishment includes:

Fine in the amount of R$ 195.23;

Addition of 5 points on your driving license;

Removal of the vehicle by winch.

With the proposed change, the financial charge of the fine of R$ 195.23 continues to be valid to guarantee the collection and rotation of urban vacancies. However, the points will not be computed on the driver's license and the vehicle will be free from the administrative measure of towing.

The rapporteur of the matter, deputy Zé Trovão (PL-SC), presented a substitute that unified PL 2816/25, by deputy Rodrigo Estacho (PSD-PR), and the attached project (PL 2857/25). The parliamentarian detailed that the relief on the wallet must be strictly restricted to non-compliance with payment for public rotating parking.

In this way, drivers who park improperly in spaces reserved for ambulances, the elderly, taxis or people with disabilities will continue to receive points on their CNH and will be subject to towing, as these infractions directly compromise the fluidity of the roads and the right to accessibility.

For the rapporteur, the current penalty for those who just forget to pay their payroll or the Zona Azul application has become disproportionate when compared to much more dangerous attitudes behind the wheel, such as driving on the wrong side of the road.

"The points system aims to remove reckless drivers from traffic, those who threaten lives", explained Zé Trovão. He also highlighted that flexibility is extremely important to protect professional drivers who, as they spend entire days on the streets, are much more exposed to the risk of losing their license document.

Next steps in Congress
The proposal is being processed conclusively, which eliminates the need for a vote in the main plenary if there is consensus in the committees. The text now goes to the Constitution, Justice and Citizenship Commission (CCJ) for evaluation.

To become definitive law and come into force throughout the country, the project will need to be approved by the Chamber of Deputies and, subsequently, by the Federal Senate.
