Tainara case: Court holds 1st hearing on woman dragged on Marginal
The first hearing in the case of Tainara Souza Santos, 31 years old, who died after being run over and dragged for more than 1 km on Marginal Tietê, in the North zone of the capital of São Paulo, takes place this Monday afternoon (25), at 1 pm, at the Barra Funda Criminal Forum.
As informed by the TJSP (São Paulo Court of Justice), the process is being processed under judicial secrecy and, as a result, only the parties involved, appointed lawyers and witnesses listed in the case file will be able to attend the trial.
This morning's hearing is expected to hear from 13 witnesses, in addition to the defendant, who must undergo interrogation. At this stage of the process, statements are taken and, subsequently, the judge will decide whether or not the defendant will be subjected to trial by a popular jury.
The Jury Trial takes place based on art. 2 of Law 167/1938, which determines that the Sentencing Council is made up of seven jurors drawn from among 21 listed, who will decide whether the defendant is guilty or innocent of the charges.
The legislation explains that jurors must be chosen from among citizens. Jury service is mandatory for those over 25 years of age and up to 60 years of age.
