STF sets big tech appeal trial for June 10th

The president of the STF (Supreme Federal Court), minister Edson Fachin, scheduled the judgment of appeals presented by digital platforms against the Court's decision that increased the liability of platforms for content published by users for June 10th.

Initially, the analysis was scheduled to take place in a virtual session, a modality in which ministers register their votes on the process's online page, without debate among themselves. The trial would begin last Friday (29), but was removed from the agenda.

Now, the appeals will be analyzed in a face-to-face session, a format that allows discussions and statements by ministers during the trial.

In the resources to be analyzed, companies such as Google and Facebook (Meta) question points of the thesis established by the court in June last year, when the STF considered an article from the Marco Civil da Internet to be partially unconstitutional.

According to the Court's current understanding, platforms can be civilly punished if they do not remove illegal content after extrajudicial notification to users, without the prior need for a court order.

In the resources, big techs allege the existence of omissions and obscurities that create legal uncertainty. Facebook requests that the rule be restricted to "manifestly" illegal content and asks for a period of six months to adapt to the new moderation obligations.

Google, in turn, requires the establishment of strict criteria for notifications, such as the identification of the complainant and the precise indication of the link under suspicion.
