Public Ministry forwards case involving a company that operated without a contract at Corinthians to the PF

The Public Ministry of São Paulo (MPSP) referred the investigation involving Mega Assessoria Operacional Ltda, a company cited in the investigation into the performance of security professionals within Corinthians, to the Federal Police.
According to information from UOL, the order was signed by prosecutor Cassio Roberto Conserino last Friday and determines that a copy of the case be sent to the Private Security Control Office (Delesp), a sector of the Federal Police responsible for supervising companies that provide private security services.
According to the document, a consultation carried out with Mega Assessoria's CNPJ indicates that the company does not have authorization from the Federal Police to operate in the private security segment. The prosecutor also states that there is sufficient evidence for the company's actions to be analyzed based on the Private Security Statute, legislation that establishes the rules for the operation of this type of activity.

Also according to the order, the understanding was based on the analysis of statements collected during the investigation, documents sent by Corinthians, requests presented by club members and a written statement from Fernando José da Silva, known as Nandão, partner and owner of Mega Assessoria Operacional Ltda.
In Conserino's assessment, the material gathered indicates that the company had operated on Corinthians' premises with "possibly armed" security guards, without meeting the legal requirements for providing this type of service.
With the decision, the entire content of the investigation will be forwarded to the Federal Police, with Delesp being responsible for analyzing the documentation and deciding whether there will be any action at the federal level.
The order also mentions the possibility of the conduct falling within article 50 of the Private Security Statute, which deals with the provision of security services without operating authorization. The prosecutor adds that the investigation considers information that the company continues to operate.
Despite being forwarded to the Federal Police, the order does not represent a conclusion about the occurrence of a crime nor does it constitute a judicial decision. This involves sending the material for analysis by the competent authority.
Divergences
The main divergence in the investigation is related to the nature of the service provided by Mega Assessoria Operacional. While the Public Ministry understands that there is evidence of activity in the area of private security, the company maintains that it only carried out access control of people, an activity that, according to its defense, does not depend on authorization from the Federal Police.
In May, when the investigation began, the company's owner, Fernando José da Silva, known as Nandão, told UOL that Mega Assessoria does not provide private security services. According to him, the company's activities are limited to controlling the entry and exit of people, without performing functions covered by the legislation that regulates security companies.
The Public Prosecutor's Office, however, considers that the elements gathered throughout the investigation justify an analysis from the perspective of the Private Security Statute. For this reason, prosecutor Cassio Roberto Conserino decided to forward all documentation to the Federal Police, which will be responsible for evaluating whether there were irregularities.
Mega Assessoria's work also became part of the political crisis experienced by Corinthians in recent months. The topic was raised by club members and cited in impeachment requests presented during the period of administrative instability.
The Public Prosecutor's Office itself mentions documents sent by Corinthians and requests made by associates among the elements considered in the investigation. Furthermore, Fernando José da Silva also began to be mentioned in different episodes linked to Corinthians' political crisis, and the referral of the case to the Federal Police represents yet another development in the investigation.
