PGR defends the validity of the dosimetry law and calls for rejection of actions in the STF

The PGR (Attorney General's Office) defended the Dosimetry Law and told the STF (Supreme Federal Court) that the request to prevent the reduction of sentences for those convicted on January 8th should be rejected.

"The opinion is to reject the precautionary request to suspend the contested rules", he says. The PGR's demonstration took place within the scope of four ADIs (Direct Actions of Unconstitutionality) under the rapporteur of Minister Alexandre de Moraes.

The actions question central points of the law, such as the creation of a reason to reduce sentences for crimes committed in a "crowd" context, the facilitation of regime progression for crimes against the Democratic Rule of Law and the remission of sentences for those under home rule.

In the document, Attorney General Paulo Gonet Branco argued that the Legislative Branch has constitutional autonomy and "margin of conformity" to define the country's criminal policy and punishment criteria.

According to the head of the PGR, the fact that the measure directly benefits defendants from specific high-profile episodes does not nullify the general nature of the law.

The legislation was enacted by Congress after the full veto of President Luiz Inácio Lula da Silva (PT) was overturned. The text was the target of actions in the STF filed by the PDT, the PSOL-Rede federation, the federation formed by PT, PCdoB and PV, in addition to the ABI (Brazilian Press Association).
