PGR adopts caution with Vorcaro's plea proposal and remains unclear

Members of the PGR (Attorney General's Office) who negotiate with Daniel Vorcaro's lawyers a proposal for a plea bargain adopt a cautious stance in relation to the negotiations. According to CNN Politics analyst Teo Cury, to CNN Novo Dia, the Prosecutor's Office continues to analyze the annexes presented by the ex-banker's defense and has not yet signaled a definitive decision on the case.

Daniel Vorcaro's plea bargain proposal has two fronts: one with the PF (Federal Police) and the other with the Attorney General's Office. After the PF's rejection, it is now up to the PGR to give the final word on whether or not it will agree with the Federal Police's position.

History of negotiations
The first version of the proposal was presented at the beginning of May. Twenty days later, the Federal Police rejected the agreement, arguing that there were not enough elements and that Daniel Vorcaro was more justified in the proposal than pointing out crimes committed by him or those close to him.

The PGR, however, followed the negotiations. Subsequently, the PF returned to negotiations, but again rejected the proposal. The information about the new denial was passed on to the defense on Wednesday (10), and Minister André Mendonça, from the STF, was informed on Thursday (11).

According to Teo Cury, both the PF and the PGR have shown resistance to the proposal for the same reasons: the assessment that Vorcaro did not assume his responsibilities, did not admit crimes he had committed and did not point out the responsibility of other people.

"He is more shielding himself and shielding people in the investigators' assessment", said the analyst. If the PGR closes the agreement, the text must be forwarded to André Mendonça, who will be responsible for evaluating and deciding whether or not to validate the plea.

Evidence and criteria for approval
The Federal Police currently have eight cell phones seized from Daniel Vorcaro, in addition to a vast amount of messages and documents obtained during eight operations launched since November.

According to Teo Cury, three criteria are necessary for the approval of a plea bargain agreement: the presentation of new elements, the corroboration of existing evidence and the collaborator's ability to repay the public coffers.

In the case of Vorcaro, the estimated loss is between R$40 billion and R$60 billion, and there is still no consensus on its ability to return this amount.

PGR does not work with deadlines
The lack of definition regarding the PGR schedule is a point of attention. As Cury reported, the Prosecutor's Office made it clear that it does not work with deadlines and will make its decision when it considers the appropriate time.

Unlike the PF, which was more vocal in its discontent with the proposal, the PGR has acted more discreetly. "Talking to those who follow it, there is still resistance. It's no surprise that the PGR has not yet given a final word on this matter", highlighted the analyst.
