OpenAI defeats xAI lawsuit over alleged trade secret theft

A United States federal judge rejected this Monday a lawsuit filed by xAI, Elon Musk's artificial intelligence company, which accused Sam Altman's OpenAI of appropriating the company's commercial secrets.

Judge Rita Lin, from San Francisco, stated that xAI was unable to prove that OpenAI encouraged the company's former engineer Xuechen Li to improperly obtain confidential information.
According to the judge, there is also no evidence that Li revealed xAI's commercial secrets during a presentation made while participating in an OpenAI recruitment process.
Lin closed the process definitively, stating that it would be "useless" to allow xAI to continue with the action. In February, it had already rejected a previous version of the lawsuit.

Originally filed in September last year, the lawsuit alleged that former xAI employees took confidential information from the company, including source codes related to the Grok chatbot, when they left their positions to work at OpenAI.
xAI is part of the SpaceX group, controlled by Elon Musk and operates in the areas of space, satellites and artificial intelligence.
xAI's lawyers did not immediately respond to the requests for comment.
