Opposition deputies are pushing for the installation, by next week, of the special commission that will analyze the proposal to reduce the age of criminal responsibility to 16 years. The group hopes to coordinate approval of the agenda before the elections. Leaders interviewed by CNN, however, believe that the issue should only move forward after the electoral period.


On Monday (6), the president of the Chamber, Hugo Motta (Republicanos-PB), decided to create the PEC commission (Proposed Amendment to the Constitution).


The bench heads must now indicate the members of the panel. A previous agreement provided for deputy Mendonça Filho (PL-PE) to be the rapporteur on the matter and for the committee to be chaired by deputy Aluisio Mendes (Republicanos-MA).


The division was made during the processing of the Security PEC, which was reported by Mendonça. At the time, he included the reduction of the age of criminal responsibility in the text, but removed the section after Hugo Motta's commitment to discuss the issue in a separate proposal. Aluisio Mendes was also president of the special committee that evaluated the text.


"Without a doubt, we will work to get it approved before [the elections]", said opposition leader, Cabo Gilberto Silva (PL-PB) to CNN.


At a meeting of Chamber leaders on Tuesday (7), however, bench heads defended that controversial topics be analyzed after the election.

The change in the age of majority faces resistance from left-wing parties, but has support from members of center acronyms, in addition to the opposition. Heard with reservation, leaders claim that the text has the support of around 70% of Congress.


"We will face this issue. We have no difficulty, we have a position of merit. We will face this issue during the campaign and after the campaign", declared the leader of the PT in the Chamber, Pedro Uczai (SC).


The optimism regarding the support of deputies is due to two factors. Firstly, due to the expressive vote that the proposal had in the CCJ (Constitution and Justice Commission), in June. There were 44 deputies in favor and 18 against.


The second point is the support of a portion of the population for the measure. A Datafolha survey released at the end of June shows that 79% of respondents support reducing the age of criminal responsibility. The percentage is the lowest recorded in the historical series, which began in 2003. Of the total number of respondents, 17% said they were against this type of measure and 1% were indifferent. Another 3% don't know.


This data is used by the opposition to press for the issue to advance in Congress. PL leaders have reinforced their intention to vote on the text as quickly as possible to have an important electoral asset.


The reduction is one of the flags that must be defended by members of the opposition during the electoral campaign as one of the actions to combat crime. On the other hand, left-wing parliamentarians believe that the age of majority at 18 is a fundamental clause of the Constitution and that reducing the age would only burden the penal system.


The leaders of the progressive parties await the definition of a schedule by the special commission to outline the obstruction tactics and the strategy for the votes.


The special commission that will analyze the matter will have 38 full members and an equal number of substitutes. After analysis by the collegiate, the text will still be voted on, in two rounds, in the Chamber plenary. If approved, it will go to the Senate.
