MP cites 38 lawyers arrested in SP in action on Deolane

A survey presented by the MPSP (Public Ministry of São Paulo) shows that 38 people entitled to special prison are held in the São Paulo prison system, including 20 lawyers. The report was made based on official information from SAP (Secretariat of Penitentiary Administration) and TJSP (Court of Justice of São Paulo).

The data was attached to an opinion from Gaeco (Special Action Group to Combat Organized Crime) in the case of influencer and lawyer Deolane Bezerra.

The document is used by the Public Prosecutor's Office to contest the request of the defense and the OAB (Brazilian Bar Association) to transfer Deolane to a General Staff Room.

According to the agency, other lawyers remain imprisoned in special state cells without there being widespread requests from the entity for this type of transfer.

According to a letter signed by the general director of the Criminal Police, Rodrigo Santos Andrade, sent to prosecutor Lincoln Gakiya, São Paulo has 33 special cells for prisoners entitled to special imprisonment.

The spreadsheets attached to the process show that 38 people occupy these units. In addition to the 20 lawyers, there are delegates, police officers and other professionals covered by the legislation.

Defendant for criminal organization
The habeas corpus is analyzed in the context of the criminal action in which Deolane Bezerra is responsible for the crimes of criminal organization and money laundering.

The complaint, presented by the Public Ministry within the scope of Operation Vérnix, was accepted by the São Paulo Court. According to the accusation, the influencer was part of a money laundering scheme linked to the PCC (Primeiro Comando da Capital).

According to investigations, the group used a transport company in Presidente Venceslau to move funds of illicit origin, including through the technique known as "smurfing", which consists of making fractional deposits to make it difficult to trace the money.

Before receiving the complaint, the judge rejected the proposal for a non-criminal prosecution agreement, accepting the Public Prosecutor's Office's understanding that the legal requirements were not present.

In the process, the Court ordered the blocking of R$27,002,774.72 in Deolane's bank accounts and the seizure of assets, including luxury vehicles registered in the name of his company.

Disagreement over prison conditions
In parallel with the criminal action, the OAB questions the lawyer's custody conditions at the Tupi Paulista Women's Penitentiary.

After an inspection carried out by the Rights and Prerogatives Commission, the entity stated that the place does not meet the requirements of a General Staff Room and reported problems such as small cells, deteriorated mattresses, sheets with a musty odor, the presence of insects and reports of searches considered humiliating.

In response to the Public Prosecutor's Office, the SAP (Secretariat of Penitentiary Administration) contested the OAB's conclusions. According to the ministry, the cells are 7.26 square meters, above the minimum required by law, the unit undergoes periodic pest control and searches follow security protocols.

The prison administration also reported that Deolane requested authorization to remain in the same cell as lawyer Lizandra de Carvalho Lardelau, citing panic syndrome and fear of remaining alone during the night.

Requests for freedom
Before this Monday's trial, requests for habeas corpus presented by the defense were denied by the TJSP and the STJ (Superior Court of Justice).

The defense alleged excessive time in pre-trial detention and requested that custody be replaced with house arrest so that Deolane could take care of her 12-year-old daughter. The arguments were rejected by both courts.

In addition to the criminal action, the OAB-SP preventively suspended Deolane's professional registration for 90 days, a period that can be extended while the Ethics and Disciplinary Court analyzes the case.

After the preventive detention was maintained, the influencer's sister, Dayanne Bezerra, criticized the decision on social media and classified the arrest as "inhumane".
