Moraes evaluates Bolsonaro's home after PGR and defense demonstration

After receiving arguments from the defense and statement from the PGR (Attorney General's Office), minister Alexandre de Moraes, from the STF (Supreme Federal Court), will decide whether or not the possession of a weapon registered in the name of Jair Bolsonaro (PL) should be a reason to remove the former president from house arrest.

In a statement sent to the Supreme Court, the Attorney General of the Republic, Paulo Gonet, defended that the court awaits the conclusion of the investigation conducted by the 17th Police Station of the Federal District. On Saturday (27), the former president's defense asked Moraes to rule out the hypothesis of serious misconduct and maintain house arrest.

According to the lawyers, the weapon, a 9 mm Glock, was registered and was already at Bolsonaro's residence before the conviction. They state that there was no order to seize or revoke the registration.

The lawyers claim that there was no concealment of the weapons, tampering with records or attempts to impede the inspection. They also stated that ownership of the weapon was recognized from the beginning and was never treated as a clandestine circumstance.

With the manifestations presented, it will be up to the rapporteur to decide whether the episode will have an impact on the continuity of the benefit.

Moraes has already indicated that possession of a weapon while serving a custodial sentence can be classified as serious misconduct. When asking the parties to comment, the minister cited article 50 of the Criminal Execution Law, which considers the improper possession of an instrument capable of harming another person to be a serious offense.

Bolsonaro is serving a sentence of 27 years and 3 months in prison. If the minister understands that there was serious misconduct, the former president may suffer consequences in the execution of the sentence, such as the review of humanitarian house arrest.
