Moraes awaits defense to explain possible "foul" at Bolsonaro's home

Minister Alexandre de Moraes, of the STF (Supreme Federal Court), awaits the statement from Jair Bolsonaro's (PL) defense to decide whether the possession of a firearm in his residence constitutes "serious misconduct" during the execution of humanitarian house arrest. The former president completed 90 days at home last Wednesday (24).

The case was opened after the seizure of a 9 mm Glock pistol registered in the name of the former president. The weapon was found on June 15 in a vehicle driven by military officer Estácio Leite da Silva Filho, who works in Bolsonaro's security.

In a statement to the Civil Police, Bolsonaro admitted to owning the pistol and claimed to keep it at home while under house arrest. He justified the inauguration by saying that he could not "be unarmed" because he had "three women at home", his wife, Michelle, his daughter, Laura, and his stepdaughter, Letícia.

According to Moraes, the Criminal Execution Law classifies the improper possession of an instrument capable of injuring third parties as serious misconduct. If the infraction is recognized, Bolsonaro may face sanctions during the execution of the sentence, including regime regression and the end of humanitarian house arrest.

Before deciding whether the seizure of the firearm could impact the former president's house arrest, Moraes granted a 48-hour deadline for demonstrations by the PGR (Attorney General's Office) and the defense.

In the opinion sent to the STF on Thursday (25), Paulo Gonet recommended that the Court wait for the conclusion of the investigation into the seized pistol. For the PGR, the episode is still in its initial phase and, for now, there are not enough elements to characterize disciplinary misconduct or non-compliance with the conditions imposed on the former president.

The position also points out that the classification of an offense as serious "requires more than the subsumption of the fact to the norm, demanding the analysis of the impacts of the illicit conduct on the legal order and on the object and purpose of criminal execution".

With the PGR's opinion already added to the case file, the process now awaits the defense's response. Moraes will then decide whether to order Bolsonaro's return to the 19th Battalion of the Military Police of the Federal District, Papudinha, or whether to follow the guidance of the Public Ministry and await the outcome of the investigation conducted by the DF Civil Police.
