Justice denies Deolane's request for freedom and influencer remains in prison

The São Paulo Court of Justice (TJ-SP) denied a new request for habeas corpus presented by Deolane Bezerra's defense against her preventive detention. The influencer's lawyers are now awaiting judgment on the merits and are considering appealing to the STJ (Superior Court of Justice).

The refusal of the injunction was taken one day after the arrest, on Friday (22). She is suspected of involvement in a money laundering scheme linked to the PCC (Primeiro Comando da Capital).

Previously, another request presented to try to obtain Deolane's freedom was also filed with the Court. When analyzing the case, however, the magistrate understood that he did not have the competence to judge the request. Therefore, the request was not acknowledged and the case was filed in that specific court.

In addition to the decision of the São Paulo Court, the minister of the Federal Supreme Court (STF), Flávio Dino, denied the request for house arrest made by the influencer's defense.

With the decisions, the lawyer remains imprisoned in the Tupi Paulista Women's Penitentiary, in the interior of São Paulo. She is in custody in a General Staff room, a prerogative provided for in the Law Statute for professionals regularly registered with the OAB (Brazilian Bar Association). The measure guarantees that lawyers detained on a precautionary basis are not kept in common cells before a definitive sentence.

When contacted, lawyer Aury Lopes Júnior, responsible for Deolane's defense team, stated that the arrest is "illegal and exaggerated" and that, therefore, he will file an appeal in the Superior Courts.

"So, let's make it very clear, this arrest is illegal, unnecessary, everything will be duly demonstrated and proven when we are given the opportunity to speak, because she was never called. We are waiting first for her freedom, which we trust will be a matter of time, will be obtained, because it is an illegal arrest, and then defend the process with complete tranquility", he concluded.

Why was Deolane arrested?
According to investigations, the influencer had close ties, both personal and business, with one of the ghost managers of a transport company investigated by the authorities. The lawyer's financial structure would have been used to give the appearance of legality to the faction's illicit resources. In total, she opened 35 shell companies at the same address to launder the money.

One of the clues collected by investigators came from a cell phone seized from the company's owners, where proof of direct deposits were found to two Deolane accounts. The investigators point out that the transfers took place in a context of "closing accounts" for the PCC, and not as payment for legal legal services.

As a result, the influencer, according to the police, began to occupy a prominent position in the case due to significant financial movements, asset incompatibilities and signs of connection with members of the PCC's core command.

Transfer and staff room
The lawyer was transferred on Friday morning (22) to the Tupi Paulista Women's Penitentiary, in the interior of the state.

Now, she remains in custody in a special cell. The court decision that authorized Deolane's preventive detention had already determined that she would be detained in this General Staff room, a prerogative provided for in the Law Statute for professionals regularly registered with the OAB (Brazilian Bar Association). The measure guarantees that lawyers detained on a precautionary basis will not be held in common cells before final sentencing.

Therefore, the measure does not prevent the person from being arrested and does not change the course of the investigation, it only ensures that custody is differentiated due to the professional prerogatives of the lawyer.

In practice, the environment allocated to Deolane is separated from the common prison population, without internal bars typical of a conventional cell and with conditions compatible with the preservation of legal prerogative.

Despite having the right to a special cell, the Union's complaint goes further and says that she would have received greater benefits, not foreseen in the prerogatives guaranteed by the Lawyers' Statute.

Statement of the investigated
In a statement, Deolane's defense expressed itself. Read in full:

"The technical defense of lawyer Deolane Bezerra Santos comes, with the utmost respect to the institutions of the Justice System and the Democratic Rule of Law, to provide the necessary clarifications about the events that resulted in her preventive arrest on today's date, 21.05.26: initially we emphasize her most absolute innocence, as well as, that the facts will be duly clarified by her, at an opportune moment.

For now and as due compliance, we consider the measures signed against Deolane to be disproportionate and this defense panel will continue to cooperate technically with the Court to demonstrate the legality of its activities as a lawyer that it is, fully trusting in the discernment, reasonableness and impartiality of the Judiciary".
