Influencers who publicize illegal bets will be held responsible, says government

Digital influencers who advertise illegal betting platforms will be held tax liable, the federal government announced this Friday (19).
"If an influencer enters a social network and advertises an illegal bet, in addition to all the administrative sanctions of the SPA [Secretariat of Prizes and Apastas], the Federal Revenue will charge Income Tax and also taxes such as PIS and Cofins", stated the Secretary of the Federal Revenue, Robison Barreirinhas.
Earlier, the federal government announced that it will block resources linked to illegal betting platforms and allocate them to the National Public Security Fund, respecting due legal process.
Barreirinhas reinforced that the gains obtained through the dissemination of clandestine bets will not be exempt from taxation (read more below).

This morning, the government announced that it will block resources from illegal bets and send them to the public security fund, respecting the legal process.
The information was released by the Minister of Finance, Dario Durigan, and later confirmed in a video recorded by President Lula on the networks.
The announcement of the measure occurs the day after carrying out an operation against a scheme criminal movement of billions of dollars through illegal bets (remember more below).

Alongside the Minister of Finance, Dario Durigan, and the Minister of Justice and Public Security, Wellington César Lima e Silva, I signed today a new measure that guarantees the blocking of financial resources from illegal betting companies", says the president's publication.
"Once due process has been completed, the blocked resources will be allocated to the National Public Security Fund and will reinforce the fight against financial structures of organized crime in the country", detailed the PT member.

How will it work?
Durigan explained that the Ministry of Finance and the Ministry of Justice will block, administratively and preventively, resources that originate from games called by the government "irresponsible", that is, from platforms that operate in a irregular.
The rule signed by the president this Friday (19) defines the procedures for carrying out this blocking and the rules for sending information that will help in the investigation and seizure of the assets of these operators - resources that could be allocated to the Union.
In practice, when there is evidence that a company is exploiting bets irregularly, the Prizes and Betting Secretariat of the Ministry of Finance may notify financial institutions to block the resources linked to the activity.
➡After the blocking, a administrative process to investigate the case and decide whether the amounts will be confiscated and transferred to the Union.
➡If, at the end of the administrative process, the irregularity is confirmed, the Attorney General's Office (AGU) may appeal to the Court to request the confiscation of the resources and authorize the transfer of the amounts to the National Public Security Fund.
According to the government, the procedure must follow the rules of the administrative process, guaranteeing the right of defense and contestation of those investigated, without affecting the rights of the bettors.
This communication will include direct contact with financial institutions, according to Durigan.
"The Treasury has been building this intelligence with the Secretariat of Prizes and Bets (of the department) and with the Federal Revenue. When we identify an illegality, we will inform the banks saying: any account you have that handles the appeal of these irresponsible bets here, you should try to freeze it", informed the Minister of Finance.
