Heny Borel case: Leniel asks for annulment of Monique Medeiros' trial
Leniel Borel, father of the boy Henry Borel, filed an appeal this Monday (8) against the judicial pardon decision handed down in the trial of Monique Medeiros, which concluded in the early hours of last Thursday (4).
Prosecution assistant in the case, Leniel requests the annulment of the trial that granted Monique a judicial pardon.
The appeal maintains that there were "insurmountable defects in the formulation and conduct of the question submitted to the Sentencing Council, especially due to questions whose answers would have generated logical incompatibility with the deliberations previously expressed by the jurors".
"The appeal was filed due to the existence of irremediable defects in the formulation and conduct of the question submitted to the Sentencing Council", states Cristiano da Rocha Medina, lawyer who represents Leniel Borel in assisting the prosecution.
Prosecution assistance requires a new jury.
Convictions in the Henry Borel case
Dr. Jairinho, as Jairo Souza Santos Júnior is known, was sentenced to 43 years, 9 months and 20 days in prison for the death of Henry Borel.
Monique Medeiros, on the other hand, received a judicial pardon, a legal institute that removes the application of the penalty even after recognition of the crime. In the woman's case, the Sentencing Council recognized Monique's responsibility for torture by omission and downgraded the charge from intentional homicide to manslaughter.
After the decision, Monique left, on the afternoon of this Thursday (4), the Talavera Bruce Penitentiary, in the Gericinó Complex in Bangu, in the West Zone of Rio de Janeiro.
In an interview with Backstage CNN, Leniel Borel stated that the final sentence involving Monique Medeiros in the trial for the boy's death represented a "huge legal aberration".
"It was very clear, not only to me, but also to the whole of Brazil, of this 'biased partiality'. We are going to appeal [...] Monique, at the very least, was negligent. [...] They forget that Monique is the mother. The guarantor. She is, at the very least, responsible for her son's life. And she did not protect him", said Leniel.
