Henry Borel case: find out what the prosecution asks against stepfather and mother
The trial of defendants Jairo Souza Santos Júnior, Dr. Jairinho and Monique Medeiros, accused of the death of the boy Henry Borel, has as its central focus the prosecution's search for the maximum penalty provided by law.
The session, which takes place at the II Rio de Janeiro Jury Court this Monday (25), analyzes allegations of triple homicide, torture and other crimes that, together, can exceed decades of imprisonment.
Requests for conviction and sentence time
The prosecutor's assistant and father of the victim, Leniel Borel, stated in an interview that his expectation is that justice will be done in proportion to the brutality of the crime.
The prosecution is working to obtain a sentence that, in Leniel's understanding, should be at least 50 to more than 70 years in prison for each of the defendants.
To support these requests, the Public Prosecutor's Office relies on the following qualifications and crimes:
- Triple qualified homicide: Using torture and a resource that made it impossible to defend the victim.
- Torture: Accusation of subjecting the child to physical and mental suffering.
- Coercion and Fraud: Attempts to influence witnesses and manipulate the crime scene.

Specific accusations against Jairinho and Monique
The accusations differ for each defendant depending on their participation in the event.
Against former councilor Dr. Jairinho, the request is based on the direct authorship of the physical attacks that caused the death.
Against Monique Medeiros, the prosecution maintains the relevant omission, claiming that the mother had a legal duty of protection, was aware of the previous attacks and consented to the situation.
In addition, Monique is charged with fraudulent misrepresentation for allegedly lying at the hospital to cover up for her partner.
The role of jurors and the sentence
The final decision on the guilt or innocence of the accused rests with the Sentencing Council, made up of seven randomly selected citizens.
If the jurors decide to convict, the judge presiding over the session will determine the sentence, defining the exact time of imprisonment based on the Penal Code and the seriousness of the infractions.
Understand the case
Henry Borel, aged 4, died in the early hours of March 8, 2021 in Barra da Tijuca, Rio de Janeiro.
Initially, the couple claimed that the child had suffered a domestic accident when he fell out of bed, but the IML report ruled out the hypothesis by identifying 23 injuries to the body.
The cause of death was internal bleeding and liver laceration due to blunt force.
Civil Police investigations, aided by technology that recovered deleted messages, concluded that the boy was living a routine of torture carried out by his stepfather with his mother's knowledge.
The case led to the creation of the Henry Borel Law, which made homicide against children under 14 a heinous crime.
