Government investigates whether porn sites prevent access to minors

Pornographic sites ask for self-declaration of age

The National Data Protection Agency (ANPD) reported this Friday (19) that it will monitor websites with pornographic content and escort services. The objective is to verify whether they are acting to prevent access by children and adolescents.
The inspection will reach 18 websites with content and services prohibited for minors, which represent 98% of online traffic of this type in Brazil, according to the ANPD.
The Digital Statute of Children and Adolescents (ECA Digital), which became law in September 2025, obliges platforms with inappropriate content for minors under 18 to verify the age of their users.
How self-declaration of age is prohibited, websites cannot have blocks that can be bypassed by clicking on buttons like "Yes, I am over 18 years old". The rule was also adopted in the United Kingdom, where sites lost audience after improving age verification.

Platforms activated by the ANPD have 10 working days to respond to which measures they have adopted to verify the age of users and how they comply with the minimum requirements defined by the agency.
Companies must also inform which protection mechanisms are applied in cases where it is not possible to confirm the age of users.
If they do not respond to the ANPD's questions, the platforms will be subject to administrative proceedings that may result in sanctions including warnings, fines and blocking in the country.
