Former BBB Marcos Harter receives new punishment from the Federal Council of Medicine

The Federal Council of Medicine (CFM) judged the appeal presented by former BBB and doctor Marcos Harter, 47, and changed the punishment previously received by the professional. Harter was disciplined for violations of the Code of Medical Ethics.

According to the decision published in the Official Gazette of the Union, the CFM Superior Court of Medical Ethics unanimously decided Harter's guilt. The judgment concludes that the former BBB 17 participant violated articles 1, 23 and 32 of the Code of Medical Ethics. The articles stipulate:

- Art. 1. Causing harm to the patient, through action or omission, characterized as malpractice, imprudence or negligence.
- Art. 23. Treating human beings without civility or consideration, disrespecting their dignity or discriminating against them in any way or under any pretext.
- Art. 32. Failing to use all available means of promoting health and preventing, diagnosing and treating diseases, scientifically recognized and within your reach, in favor of the patient.

Although Harter's appeal was found guilty again, there was a change in the sentence imposed. The previous determination punished him with the suspension of his right to practice medicine for 30 days, and the new sanction stipulates that the penalty should be "public censorship in an official publication".

The Official Gazette of the Union does not detail what happened that led to Harter being convicted. In a note to CNN Brasil, the Federal Council of Medicine clarified that it is determined that ethical-professional processes must be processed in procedural secrecy.

For CNN Brasil, Marcos Harter reaffirmed his respect for the Federal Council of Medicine and said he received the new determination with "serenity". However, the plastic surgeon questioned the conduct of the procedure in relation to the current CRM/MT inspector, Dr. Magno Cezar, who was the case's rapporteur.

According to Harter, Cezar and he work in the same segment of medicine, "including with similar models of action", and that there would be a "historical personal animosity between the parties", which "would compromise the necessary impartiality that is expected from any ethical-disciplinary procedure".
