Family of man killed by late tumor will receive compensation

The São Paulo Court upheld the decision and held the municipality of Piracicaba responsible for the late diagnosis of a brain tumor in a man, who died. The victim's partner and two children will be compensated R$30,000 each.

The decision was decreed by the 5th Public Law Chamber of the São Paulo Court of Justice, which maintained the decision of the Piracicaba Public Finance Court.

The authors pointed out that throughout the treatment, it took six medical appointments in a public health unit, totaling 57 days, to carry out a tomography that allowed late diagnosis.

The man then underwent surgery and a radiotherapy session, but could not resist the severity of the condition and died.

The case rapporteur pointed out that the expert evidence concluded that the lack of attention due to the patient's clinical condition may have contributed to the worsening of his health status, including the failure to carry out adequate oncological treatment.
