Fachin promises "balanced" solution to uberization trial

The president of the STF (Federal Supreme Court), minister Edson Fachin, stated this Friday (29) that the Court will seek a "balanced" solution in the judgment that will discuss the existence of an employment relationship between application drivers and delivery people and digital platforms.

During a visit to Manaus, Fachin said that the issue has been debated by the Supreme Court for years and that the Court heard representatives from the most diverse sectors involved before taking the case to trial.

"The time has now come to present an answer to these crucial questions, a balanced answer, based on constitutional rights and duties, that, at the same time, is lucid and sensitive to protect workers and that also understands the importance of this tool for the contemporary world", he stated.

According to the minister, the case is "instructed and matured" and will begin to be judged by the Court's plenary on June 24.

The process was presented by Uber and is being processed in conjunction with an action by Rappi. Companies question Labor Court decisions that recognized employment relationships between platforms and workers.

The discussion is considered one of the most relevant being analyzed by the Supreme Court as it involves the hiring model used by application companies and its impacts on labor rights. The Court's definition should serve as a parameter for thousands of similar cases being processed in Brazilian justice.
