The president of the STF (Supreme Federal Court), minister Edson Fachin, determined this Wednesday (3) that the PGR (Attorney General's Office) respond, within 72 hours, on a request from the PL (Liberal Party) to suspend a decision by minister Flávio Dino related to the supplementary elections for the government of Roraima.

After the PGR's opinion, the process will return to the Presidency of the STF for analysis.

The action was filed by the PL against a preliminary decision by Dino that ordered the TRE-RR (Regional Electoral Court of Roraima) to review the calendar of the supplementary elections scheduled for June 21, specifically in relation to the rules for disqualifying candidates.

Last week, Dino understood that the TRE-RR could not set a deadline of just 24 hours for occupants of certain public positions to leave their positions before contesting the election.

The minister then reestablished the mandatory deadlines set out in a complementary law from 1990, which range from 3 to 6 months of prior leave, taking as a reference the date of the election in June.

The PL maintains that the decision creates legal uncertainty and could compromise the competitiveness of the dispute. According to the party, the retroactive application of the deadlines set out in electoral legislation would make candidacies already registered for the supplementary election unfeasible.

In the petition presented to the STF, the party argues that the measure could result in only one candidate remaining eligible for the contest and states that this would pose a risk to the legitimacy of the election.

In addition to questioning the effects of the decision, the party also maintains that the Republicans, author of the complaint accepted by Dino, would have appealed directly to the STF without exhausting the lower levels of the Electoral Court.

The supplementary election was called after the TSE (Superior Electoral Court) confirmed the impeachment of former governor Antonio Denarium and vice Edilson Damião for abuse of political and economic power in the 2022 elections.
