Fachin cites 75 million cases when defending AI in the Judiciary

The president of the STF (Supreme Federal Court) and the CNJ (National Council of Justice), minister Edson Fachin, defended this Tuesday (30) the use of Artificial Intelligence to help the Judiciary identify abusive procedural conduct and prevent so-called predatory litigation.

The statement was made during the launch of the Atalaia Project, at the CNJ. The platform will use Artificial Intelligence to map, on a national scale, litigation patterns in the country.

In a speech, Fachin stated that Brazil is experiencing a high volume of legal actions in progress. According to him, the country currently has around 75 million cases.

"Brazil continues, at this moment, with 75 million processes. If we look at the Brazilian population, or the electorally active population, we can say that there is practically one process for every two people among voters in Brazil", he said.

Data consolidated by the CNJ show that the Judiciary entered 2026 with 75,011,830 pending cases. The number represents a drop compared to 2024, when there were 79,058,580 pending cases. In 2023, the stock was even greater: 84,374,909 shares in progress.

For Fachin, the volume of cases should be seen as a sign that the State's response still needs to improve.

"This should be seen as a still inefficient response from the Brazilian State. And we need partnership and union with people in the public and private sphere who want to make this country work", he stated.

The Atalaia Project was presented as a tool to assist courts in identifying artificial demands, abusive procedural conduct and patterns of mass judicialization.

The minister highlighted, however, that the use of Artificial Intelligence does not replace the work of magistrates. According to him, final validation will continue to be the responsibility of judges.

"No intelligence, no matter how sophisticated, can do without functional independence. At the center of the decision remains the human person", he stated.
