Expert: Agency with management appointed by Lula will regulate digital

ANPD (National Data Protection Agency) is becoming the main regulator of the digital environment in Brazil. The assessment is by technology and internet specialist Carlos Affonso, law professor at UERJ (State University of Rio de Janeiro), in an interview with Agora CNN.

The expert explained that the ANPD was created in 2018, linked to the LGPD (General Personal Data Protection Law).

"The agency's mission is to monitor and sanction practices related to the processing of personal data", he stated. Affonso detailed that, over time, the body took on the format of a regulatory agency, which implies greater budgetary autonomy and independent directors.

However, the professor highlighted a relevant point: the agency's directors are appointed by the President of the Republic himself. Currently, ANPD has two vacant directorships that still need to be filled.

In addition to its original function, the ANPD received, at the beginning of this year, the authority to monitor the so-called digital ECA - the law that deals with the protection of children and adolescents on the internet. More recently, through a decree, the agency also became responsible for dealing with issues related to content moderation and the governance of digital platforms.

For Affonso, the accumulation of duties transforms the ANPD into a comprehensive regulator. "Ultimately, the ANPD, with these new decrees, becomes the true regulator of digital issues in Brazil," he said.

The expert added that, with this expanded scope - which includes leaks of personal data, protection of children online, freedom of expression and content moderation on platforms -, the agency should occupy more and more space in the news.
