Dino returns visa and STF should analyze Rio's buffer mandate in August

The STF (Supreme Federal Court) is expected to resume, in August, the trial that will define the rules for succession in the case of a buffer mandate in the government of Rio de Janeiro. The process was released to return to the agenda this Tuesday (30), after minister Flávio Dino returned the review request (more time for analysis).

The case began to be tried in April this year. The trial discusses what the format of the supplementary election should be after the vacancy in the positions of governor and vice-governor of Rio.

The Constitution provides for a new election to complete the term of office by December 31st, but there is disagreement as to whether the choice should be made directly, with popular vote, or indirectly, by Alerj (Legislative Assembly of Rio de Janeiro).

Before the suspension of the trial by minister Flávio Dino, the score was 4 to 1 in favor of holding an indirect election.

When asking for more time to think about the case, Dino stated that he would wait for the publication of the TSE ruling that made Cláudio Castro, former governor of Rio, ineligible to clarify points considered essential for defining the format of the dispute.

The TSE published the ruling on the night of April 23rd. The document maintained the understanding that Castro was ineligible, but his mandate was not revoked because he resigned from office before the conclusion of the electoral trial.

While the STF does not consolidate a final understanding on the issue, the then president of Rio's court of justice, Ricardo Couto, is acting as governor on an interim basis.
