Dino imposes fine for lack of transparency in amendments to the events sector
Minister Flávio Dino, of the STF (Supreme Federal Court), ordered this Tuesday (9) the application of fines to states and municipalities that received parliamentary amendments to hold events between 2020 and 2024 and did not comply with the transparency requirements defined by the Supreme Court. According to the minister, the fine will be 1% of the value of the amendment received and applied daily until the situation is regularized.
The decision was taken within the scope of actions that deal with the transparency and traceability of the so-called "Pix amendments". According to the minister, there are still omissions in the presentation of work plans, management reports and financial statements related to funds allocated to the events sector.
The focus of the investigation is on resources that benefited companies included in Perse (Emergency Program for the Resumption of the Events Sector), created during the covid-19 pandemic to grant tax incentives to the sector.
Dino stated that, after more than a year of demands by the STF, federal agencies were still unable to gather all the necessary information because states and municipalities failed to present mandatory documents. According to the minister, the lack of data compromises the monitoring of the application of public resources and makes it difficult to control possible irregularities.
In the decision, the judge cited information sent by the AGU (Attorney General of the Union) according to which part of the work plans linked to the amendments is still in the complementation phase. Cases were also identified in which documents did not provide complete information about contracted suppliers.
For Dino, the situation reveals "persistent deficiencies in transparency and traceability" in the allocation of resources for events. The minister stated that the scenario is especially worrying when it involves companies benefiting from Perse, a program that granted significant tax exemptions to the sector.
"This situation highlights persistent deficiencies in transparency and traceability in the allocation of parliamentary amendments aimed at promoting events, compromising the verification of the adequate application of public resources and the effectiveness of institutional control mechanisms, especially in cases in which the funds benefit companies covered by the Emergency Program for the Resumption of the Events Sector - Perse, a regime that, due to the significant tax benefits granted, requires a high degree of integrity and control in the management of the public funds involved", he wrote Dino.
The fine will be applied to federative entities that fail to present work plans, complement documents already registered or deliver management reports.
According to the decision, the amounts collected from these fines will be allocated to a specific Union account aimed at financing transparency, control, auditing and amendment tracking actions.
