Deolane Bezerra tries to reverse arrest with habeas corpus; understand
The defense of influencer and lawyer Deolane Bezerra filed a request for habeas corpus after the preventive detention ordered as part of Operation Vérnix, which investigates an alleged money laundering structure attributed to the PCC (Primeiro Comando da Capital).
The attempt to obtain freedom appears in a decision by the São Paulo Court of Justice this Saturday (23). However, the merits of the request have not yet been analyzed.
According to the document accessed by CNN, habeas corpus was filed in favor of Deolane and indicated the guarantee judge responsible for the arrest decision as the enforcement authority. When analyzing the case, however, the judge understood that he did not have the competence to judge the request.
In the decision, the judge states that "this court lacks competence to analyze and judge the case, which falls, in this case, to one of the chambers of the E. TJSP."
For this reason, the request was not heard and the files were archived in that specific court. The judge also ordered the petitioner to ensure the correct distribution of the habeas corpus in accordance with the rules of judicial organization.
What does it mean to "not know" about habeas corpus
In criminal proceedings, when a judge "does not know" about a request, this does not mean agreeing or disagreeing with the argument presented.
In practice, it means that there was a procedural impediment to analyzing the content of the request.
In this case, the basis used was exclusively procedural: the magistrate understood that the jurisdiction to examine a possible request for revocation of the arrest would lie with one of the criminal chambers of the Court of Justice of São Paulo, and not the court on duty that initially received the petition.
Thus, legally, the current scenario is not one of habeas corpus denied, but of a request still pending consideration by the body considered competent.

Remember the case
Deolane was preventively arrested in Operation Vérnix, an investigation conducted by the Civil Police and Gaeco, from the Public Ministry of São Paulo.
According to investigators, the case investigates an alleged money laundering structure attributed to the PCC, using companies and asset movements to insert resources into the formal economy.
The investigations are still ongoing and the allegations must be analyzed by the Court, with the right to full defense.
The defense disputes the accusations and may present appeals and requests for review of precautionary measures throughout the process.

"The technical defense of lawyer Dr. Deolane Bezerra Santos comes, with the utmost respect to the institutions of the Justice System and the Democratic Rule of Law, to provide the necessary clarifications on the events that resulted in her preventive arrest on today's date, 05/21/2026. Initially, we emphasize her most absolute innocence, as well as that the facts will be duly clarified by this defense at an opportune moment. For now, and with due respect, we consider the measures signed against Deolane to be disproportionate, and this defense panel will continue to cooperate technically with the Court to demonstrate the lawfulness of its activities as a lawyer, fully trusting in the discernment, reasonableness and impartiality of the Judiciary."
