Daniel case: Justice maintains conviction of player's killer and acquits 4

The Paraná Court maintained, in a session held this Thursday (11), the conviction of Edison Luiz Brittes Júnior for the murder of football player Daniel Corrêa Freitas, which occurred in 2018. In the same decision, the acquittal of four other people involved in the case was determined.

The conviction and acquittal decisions were presented by the 1st Criminal Chamber of the Court of Justice of the State of Paraná (TJPR).

The collegiate decided to maintain the conviction of Edison Luiz Brittes Júnior to 42 years of prison in a closed regime for the crime, in addition to rejecting the requests for nullity of the trial and reduction of the sentence.

The others involved in the case, David Willian Vollero Silva, Ygor King, Eduardo Henrique Ribeiro da Silva and Cristiana Rodrigues Brittes, were acquitted. Cristiana, Edison's wife, was convicted of the crimes of procedural fraud and corruption of minors, but acquitted of charges of qualified homicide and coercion during the process.

Allana Emilly Brittes, daughter of Edison and Cristiana and also involved in the case, had been convicted by the popular jury for the crimes of procedural fraud, corruption of minors and coercion during the process.

However, the panel considered that the defendant was under 21 years of age at the time of the events and applied article 115 of the Penal Code, which establishes the reduction in statutes of limitations by half. When observing the time lapse between receipt of the complaint and the conviction, the judges decided to extinguish the punishment, that is, they recognized that the legal period for applying the penalty had already expired.

The decision, due to Allana's legal status, does not represent an acquittal, but prevents the execution of the punishment.

The Public Ministry of Paraná reported that it has not yet had access to the ruling. According to the body, after the document is made available, the content of the decision will be analyzed to evaluate possible appropriate measures.
