Court suspends meeting on removal of Romeu Tuma from presidency of the Corinthians Board

On the afternoon of this Monday (6), the São Paulo Court accepted the request from the president of the Corinthians Deliberative Council, Romeu Tuma Júnior, and ordered the suspension of the effects of the extraordinary meeting of the body held on March 23. Convened by club president Osmar Stabile, the session approved Tuma's removal from the presidency of the Deliberative Council. The information was initially released by ge.globo and confirmed by Central do Timão.
Tuma's request was based on four possible irregularities in the procedure that resulted in his removal from the presidency of the Deliberative Council. At the time, the president of Corinthians called the extraordinary meeting under the allegation that Tuma had made threats and adopted attitudes that interfered in the work of the club's executive board. To support the initiative, Stabile claimed to have documentary and testimonial evidence of the conduct attributed to the president of the Council.

However, Antônio Manssur Filho, from the 2nd Civil Court of Tatuapé of the Court of Justice of São Paulo (TJ-SP) accepted Tuma's arguments, citing that there were indeed indications of illegalities in the internal procedure adopted by the club. The order, to which Central do Timão obtained access, precisely cited the four points brought by Romeu Tuma, from the way in which the meeting was called, the non-initiation of a prior formal disciplinary process, the way in which the meeting was conducted, in addition to the absence of a statutory provision for the president of the CD to be removed in a precautionary manner.
The judge also states in the document that the call for the meeting, made by the president of the board, did not comply with the procedure set out in the Corinthians statute, since when the request is made by the president of the club, it must be forwarded to the board of the Deliberative Council, with the presidency of the body being responsible for calling the meeting within the stipulated period.
Furthermore, the judge highlights that a disciplinary process was not opened at the Ethics Commission (EC) before the measure was applied, something that, as mentioned in the order, violates article 32 of the bylaws, which provides for the right to full adversarial defense, and the Civil Code. Antônio Mansur also details doubts about the conduct of the meeting in the decision.
According to Romeu Tuma's defense, it was closed by Maria Ângela de Sousa Ocampos, then first secretary of the CD, but then ended up being reopened by the second secretary of the Deliberative Council (Denis Piovesan), something that is not foreseen in the Statute. Another justification given concerns the absence, in the Statute, of provision for precautionary removal of the CD president by the plenary, which makes the validity of the meeting questionable.
Finally, Romeu Tuma Júnior had requested, in the annulment action, the suspension, as an emergency measure, of the effects of the extraordinary meeting. The Court, after initial analysis, accepted the arguments presented by the president of the CD, who took a period of leave from his position, but has now returned to command the body.
