Court of Rome today analyzes Carla Zambelli's new extradition request
The Italian Supreme Court of Cassation analyzes this Wednesday (1st) the new extradition request of former federal deputy Carla Zambelli, presented by the Brazilian government.
The process, filed by the AGU (Attorney General's Office), refers to the conviction imposed by the STF (Supreme Federal Court) for the crimes of illegal possession of a firearm and illegal restraint.
On the eve of the second round of the 2022 elections, Zambelli threatened a journalist with a gun, while chasing him through the streets of the Jardins neighborhood, in São Paulo. For the case, she was sentenced to five years and three months in prison.
The Brazilian request also brings together the guarantees required by the Italian Court for a possible extradition, as well as information on the validity of the conviction handed down by the STF.
"The position of the Brazilian State observes the parameters established by the Extradition Treaty concluded between the Federative Republic of Brazil and the Italian Republic, as well as by international standards applicable to legal cooperation in criminal matters", informed the AGU. The body added that the procedure is being carried out under secrecy.
This is the second extradition request for the former deputy that Brazil has presented to Italy. In May, the Court of Cassation rejected the surrender of Zambelli in the case in which she was convicted in the STF for the invasion of the CNJ (National Council of Justice) systems.
In the June 11 decision, the Italian court pointed out an alleged violation of the principle of impartiality in the STF trial that condemned Zambelli. The understanding makes reference to the actions of minister Alexandre de Moraes, who, according to the view of Italian magistrates, would have accumulated the functions of judge and victim of the facts investigated.
In the same decision, the Italian Court also established three conditions for a possible extradition of Zambelli: that she serve her sentence exclusively in the Federal District Women's Penitentiary; have unrestricted access to defense and the Italian consulate; and that the Brazilian government periodically informs the Italian Embassy of his health status.
In this new process, the rapporteur is Minister Gilmar Mendes, who also forwarded to the AGU the guarantees required by the Italian Justice for a possible extradition of the former deputy.
