Court authorizes breach of confidentiality of cell phone found in Jairinho's cell

The Rio de Janeiro Court authorized the request to break the confidentiality of data from the cell phone found inside the cell of former councilor Jairo Souza Santos Júnior, Dr. Jairinho, last Wednesday (1st), in the Gericinó Complex, in Rio de Janeiro.

He is serving a sentence of 43 years, 9 months and 20 days in prison after being convicted, in June, of the crimes of qualified homicide, torture and coercion, committed against Henry Borel, aged 4, on March 8, 2021.

According to the decision, the Special Cyber Intelligence Division of the Public Ministry of Rio de Janeiro must extract the data contained in the phone.

The parties involved, including Jairinho's defense, will have 15 days to present appropriate appeals on the case.

In a statement, lawyer Rodrigo Faucz, who represents the former councilor's defense, informed that he was not notified in the decision and that he will only comment after having access to the terms and the investigation.

Cell phone found
Seppen (Secretary of State for Criminal Police) found the cell phone inside the cell where Jairinho has been serving his sentence since the beginning of June.

According to Seppen, intelligence information collected by the institution's Internal Affairs Department revealed that the inmate was in possession of a cell phone. When scanning the space, the agents found the device among books.

Seppen's General Inspectorate reported that it had initiated disciplinary proceedings to investigate the facts. Still according to the organization, Dr. Jairinho was placed in isolation.

"The institution reinforces that it maintains constant supervision in prison units, acting to prevent the entry and circulation of prohibited items, and guarantee security in the Rio de Janeiro prison system", stated Seppen.

Remember the case
Henry Borel died in the early hours of March 8, 2021, in the apartment where he lived with his mother, Monique Medeiros, and stepfather, in Barra da Tijuca.

According to investigations, the child was taken unconscious to the hospital, where the medical team found that the boy arrived dead.

Initially, Monique and Jairinho claimed that Henry had suffered a domestic accident, falling out of bed while sleeping.

However, the autopsy report from the IML (Legal Medical Institute) ruled out this hypothesis by identifying 23 lesions spread across the child's body.

The cause of death was indicated as internal bleeding and liver laceration caused by blunt force.

Attacks and torture
Civil Police investigations concluded that Henry was subjected to a routine of attacks and torture carried out by Dr. Jairinho.

According to the investigation, Monique Medeiros was aware of the violence, having been alerted by the boy's nanny at least a month before the death, but consented to the situation.

As the process progressed, Jairinho had his mandate as councilor revoked for breach of parliamentary decorum and definitively lost his professional medical registration.

Conviction
The Rio Jury Court sentenced, on June 4, former councilor Jairo Souza Santos Júnior, known as Jairinho, to 43 years, 9 months and 20 days in prison for the death of Henry Borel, aged 4. Jurors found him guilty of double homicide and one of the crimes of torture attributed to him during the trial.

Monique Medeiros, the child's mother, was convicted of omission in the face of the torture suffered by her son and received a sentence of 1 year and 4 months in detention, already considered served. Regarding the murder charge, the jurors downgraded the crime to manslaughter, and Judge Elizabeth Machado Louro applied a judicial pardon.

During the trial, Monique accused Jairinho for the first time for her son's death. During interrogation, she stated that she believed that the former councilor was responsible for the attacks against Henry.
