The Road and Transport Committee of the Chamber of Deputies approved this Wednesday (10) a bill that aims to toughen punishments for drivers and motorcyclists caught using adulterated exhausts to produce more noise.
The proposal foresees classifying the infraction as very serious (today it is classified as serious), with a fine, vehicle retention up to regularization and more severe punishments in case of recurrence.

The bill now goes to the Environment and Sustainable Development Commission. To become law, the text needs to be approved by the Chamber and the Senate.
The text under discussion would amend the Brazilian Traffic Code (CTB) to explicitly include vehicles with an exhaust system modified for sound amplification.
Under the proposal, anyone caught with free exhaust or a defective, inoperative or tampered muffler will be subject to the maximum penalty provided for traffic violations.
The infraction would no longer be serious and would become a very serious.
The points on the driver's license would rise from 5 to 7 points and the fine would go from R$ 195 to R$ 293.

In case of repeat offense within a period of 12 months, the fine would be doubled and the driver could have the right to drive suspended for six months.
In addition, according to the proposal, the occurrence must be reported to the competent environmental agency to investigate any possible pollution crime. noise.
The project also proposes changes to the Environmental Crimes Law to include as an infraction noise pollution caused by tampering with the exhaust system of motor vehicles with the aim of producing noise above legal limits.
Proof, according to the text, can be done through vehicle inspection or technical measurement with a decibel meter.

The proposal also foresees an increase in the penalty when the infraction occurs in hospital, school or residential areas between 10pm and 6am. In these cases, the punishment may be increased by between a third and half.

"Tampered exhausts on motorcycles often exceed 100 decibels, equivalent to the sound of gunshots. Such noises cause not only discomfort, but psychological disorders, heart problems, insomnia and chronic stress", explains the deputy in the project.
After approval by the committee, the text will be analyzed in the remaining stages of processing in the Chamber before being forwarded to the Senate. If approved by Congress and sanctioned by the President of the Republic.
