Cármen says that the law continues to be the "salvation of democracy"
Minister Cármen Lúcia, of the STF (Supreme Federal Court), stated this Monday (1st) that the law continues to be the "salvation" of democracy. She defended the importance of joint action to preserve society's trust in the Judiciary and democratic institutions.
During participation in an international congress promoted by the STJ (Superior Court of Justice), the judge said that the main issue faced by contemporary institutions is how to build and guarantee citizens' trust.
Cármen noted that opinion polls frequently indicate low levels of trust in the Judiciary, but highlighted that Brazilians continue to turn to the courts to resolve conflicts. According to her, the country currently has almost 80 million cases in progress.
"Despite saying that he does not trust the Judiciary, the citizen is in court trying to resolve his issues", he stated.
For the minister, this behavior demonstrates that there remains confidence in the law as an instrument to guarantee democracy and citizenship.
"We continue to trust in the law, especially because we have no other way. The law continues to be the salvation for a strong democracy", he declared.
The minister also defended a "constitutionally active" Judiciary, guided by impartiality, integrity and transparency.
According to her, it is necessary for the population to better understand the functioning of democratic institutions to prevent individual errors from being interpreted as structural failures of the system.
When addressing the contemporary challenges faced by the courts, Cármen highlighted the impact of new technologies and social networks. She stated that the spread of hate speech against judges could undermine public trust in the Judiciary and affect the independence of judges.
According to the minister, democracy depends on an autonomous Judiciary capable of ensuring fundamental rights.
"Imagine a person who loses a case and starts to hate the Judiciary, spreading hate speech. This dissemination can destroy the reliability of the judge in a certain place, in a certain municipality. This has been a problem that we need to solve so that the judge can act with independence and impartiality, without compromising their lives and those of their families", he stated.
The minister participated in the opening of the International Congress on the Rule of Law and Judicial Ethics, held by the STJ. The meeting brings together presidents of supreme courts, ministers, magistrates, experts and representatives of international organizations from the Americas, Africa, Asia and Europe.
The objective, according to the Court, is to promote the exchange of experiences between different Justice Systems, strengthening international cooperation.
The event should also feature a lecture by the minister president of the STF, Edson Fachin, and the minister president of the TSE, Kássio Nunes Marques.
It takes place on the same days as the Lisbon Forum. Held annually in Portugal, the event known as "Gilmarpalooza" is organized by the dean minister of the STF, Gilmar Mendes, and brings together authorities, jurists, politicians and academics, mainly from Brazil and Europe, to debate topics related to law, economics, democracy and public policies."
Minister Alexandre de Moraes; the president of the Chamber, Hugo Motta; and the Attorney General of the Republic, Paulo Gonet, are expected to attend.
