Bolsonaro gives up his weapon and awaits Moraes' decision on domicile

Minister Alexandre de Moraes, of the STF (Supreme Federal Court), must decide in the coming days whether to maintain the house arrest of former president Jair Bolsonaro (PL) after the defense presented new arguments to rule out the hypothesis of "serious misconduct" related to the weapon seized during a raid in Brasília.

In the statement sent to the Supreme Court on Thursday night (2), the lawyers reported that Bolsonaro was giving up the pistol and maintained that the pistol was regularly registered.

The defense also cited the PGR's opinion and the conclusion of the Federal District Civil Police investigation to reinforce that the former president did not commit any irregularity by keeping the item at home.

Moraes' analysis comes after the minister requested clarification on the episode, highlighted as one of the elements that could influence whether or not the benefit of humanitarian house arrest, granted for health reasons, will be maintained.

If the judge does not decide on an extension, the former president could return to serve his sentence of 27 years and three months in prison for attempting a coup d'état in Papudinha, where he was before obtaining the benefit.

The Attorney General of the Republic, Paulo Gonet, has already sent an opinion defending the maintenance of the domicile, claiming that the investigation into the right-wing leader's weapon does not attribute "a disciplinary offense to the convict that has a negative impact on the current regime in which he is serving his sentence".

In the early hours of June 15, the Military Police of the Federal District seized, in a raid, a firearm that allegedly belonged to former president Jair Bolsonaro (PL).

The device was in the car of Estácio Leite da Silva Filho, an Army soldier who was driving an official GSI (Institutional Security Office) vehicle.

During the approach, one of the police officers saw the weapon and asked Estácio for an explanation. The soldier stated that the pistol would be taken for repair and then returned to the owner. When the weapon was seized, the police found that it was registered in Bolsonaro's name.

At the conclusion of the investigation, delegate Thiago Boeing, from the Federal Police, understood that Jair Bolsonaro did not commit a crime. The argument is that the former president has a valid weapons registration and there was no judicial restriction to keep him at home, where he is under house arrest.

However, the delegate suggested indicting Sergeant Estácio for illegal possession of a firearm for restricted use, for transporting the item registered in the name of third parties.

Defense meets with Moraes
This week, minister Alexandre de Moraes met with the former president's defense. After the meeting, lawyer Paulo Cunha Bueno reported that the conversation revolved around Bolsonaro's health and the case of the weapon registered in his name.

At the meeting, the minister expressed "concern" about the former president's health, according to the lawyer. "The reporting minister, with great civility, gave an attentive hearing to the arguments brought forward - both with regard to the current medical situation and the issue regarding the weapon in the residence -, stating his concern regarding the health condition and the care that has been provided", declared Bueno.

The former president has been under temporary house arrest since March, after authorization from Alexandre de Moraes for health reasons. The measure's initial deadline of 90 days ended last week. However, the episode involving the weapon postponed the decision on whether to continue house arrest.
