The federal government signed, on Wednesday (20), two decrees that establish new rules for the operation of digital platforms in Brazil. According to findings from CNN Politics analyst Clarissa Oliveira on Live CNN, the strategy adopted by the government is to use these instruments to reinforce decisions already determined by the STF (Supreme Federal Court), bringing a leading role to President Luiz Inácio Lula da Silva (PT) on the issue of regulating big techs.
The movement represents an attempt to overcome the difficulties faced by the government in the National Congress, without exceeding the prerogatives of the Federal Executive. "The government is very careful not to exceed its prerogative and not legislate in place of the National Congress", said Clarissa.
History of regulatory attempts
Since the beginning of the current administration, there has been an effort to regulate social networks more effectively. The so-called Fake News PL, which would be the main instrument in this regard, ended up sinking in its attempt to be discussed in the National Congress.

One of the focuses of the new decrees is the fight against violence against women on social media. The government is also facing difficulties in Congress with the so-called Misogyny PL, which stalled in the Chamber of Deputies and became the target of criticism, including from pre-presidential candidate Flávio Bolsonaro (PL-RJ). The proposal would equate the crime of misogyny with the crime of racism, criminalizing hate speech against women on digital platforms.
Clarissa Oliveira highlighted that the decrees are part of a set of government actions aimed at female voters, considered strategic. "Lula tries to take the lead in saying that this government is looking at the spread of violence against women on social media," said the analyst.
Among the measures envisaged, social networks are obliged to remove unauthorized nude images from the air within two hours after the woman is notified.
