Minister Alexandre de Moraes maintained this Monday (25) the preventive detentions of those convicted of involvement in the murder of councilor Marielle Franco and driver Anderson Gomes, in 2018. The decision was taken after a mandatory review of precautionary measures, provided for in the Penal Code.


In February this year, the First Panel of the STF (Supreme Federal Court) condemned the defendants identified as those who ordered and organized the crime. As there are still appeals, the sentences have not started to be served definitively.


In the decision, Moraes stated that no new facts emerged capable of justifying the revocation of the arrests.

"There was no supervening fact that would alter the procedural situation analyzed by the First Panel at the time of the judgment of the criminal action", wrote the minister.


As a result, the counselor of the TCE-RJ (Rio de Janeiro State Court of Auditors), Domingos Brazão, remains in preventive custody; the former head of the Rio Civil Police, Rivaldo Barbosa; the retired PM major, Ronald Paulo Alves Pereira; and former advisor to Domingos Brazão (ex-MDB), Robson Calixto Fonseca.


The impeached deputy Chiquinho Brazão (formerly of União Brasil) remains under house arrest for health reasons.

In the trial held in February, the First Panel sentenced the Brazão brothers to 76 years and 3 months in prison. For the investigation, they were the ones who ordered the crime. They were reported by the confessed executor of Marielle's murder, former military police officer Ronnie Lessa.


Rivaldo Barbosa received an 18-year sentence for passive corruption and obstruction of justice. Ronald Paulo Alves Pereira was sentenced to 56 years in prison, while Robson Calixto received a 9-year sentence for criminal organization.
