Anac (National Civil Aviation Agency) launched, this Tuesday (16), new rules for the operation of drones in Brazil.


The municipality presented the Brazilian Civil Aviation Regulation nº 100, which replaces RBAC-E nº 94, and a specific resolution for drones with take-off weight of up to 250 grams and model aircraft.


According to the agency, regulation becomes more flexible, proportional and aligned with best international practices.

"The new rules harmonize concepts and definitions with the standards adopted by the International Civil Aviation Organization (ICAO) and other aeronautical authorities, contributing to greater international integration of Brazilian unmanned aviation", indicated the body.


Classification
With the new regulation, drone operations are now classified into categories:


- Open Category - Aimed at low-risk operations, carried out within defined operational limits, such as flights in visual line of sight, maximum height of 120 meters and without overflight by uninvolved people. In these cases, there is no need for prior authorization from Anac, as long as the applicable requirements are met.
- Specific Category - Covers operations of moderate risk or that exceed the limits of the Open category. The operator must demonstrate the safety of the operation, preferably through the methodology defined by the authority or by framing scenarios defined by Anac.
- Certified Category - Intended for operations of greater complexity or high risk, which require certification of the unmanned aircraft system, the operator and the remote pilot, in addition to more robust supervision by the agency.

Unmanned aircraft falling into the Open and Specific categories must comply with the registration requirements in SISANT (Unmanned Aircraft System). Certified Category operations must comply with the registration requirements in the RAB (Brazilian Aeronautical Registry).


Changes
Now, the categories no longer use weight classes for a model proportional to the risk of drone operation. In this way, simple operations will have simplified regulatory treatment, while more complex operations will require assessments and mitigations compatible with the risks involved.


The new Anac guidelines will have transition mechanisms for operators and manufacturers.


The authority indicated that activities falling into the Specific category, which are not covered by standard scenarios, have a period of up to two years to obtain the necessary operational authorizations.


In addition, administrative acts based on previous regulations will remain valid until they are reviewed by the body.


A page will also be created to apply online tests for all unmanned aircraft pilots. Registration can be made from June 16th and approval is a mandatory requirement for all categories.


Drones weighing up to 250 grams
Just this Tuesday, the agency published a specific resolution for drones with a takeoff weight equal to or less than 250 grams.


Model airplanes, which are unmanned aircraft used for recreational purposes, are also included in the standard.


Drones weighing up to 250 grams now have simplified regulatory treatment, compatible with the lower risk associated with this type of operation.


For models weighing more than 250 grams, safety requirements remain, such as a maximum height of 120 meters and airspace access rules established by the Department of Airspace Control (Decea).
