In a session held this Tuesday morning (9), the CNJ (National Council of Justice) approved, by unanimous vote, the establishment of a PAD (Disciplinary Administrative Process) against judge Magid Nauef Láuar, of the Court of Justice of Minas Gerais, removed due to allegations of sexual abuse.


The decision, which took place during the 9th Ordinary Session of 2026, was motivated by the complexity of the case and complaints collected so far. The councilors also voted to maintain Láuar's removal from his duties.


At least five statements from people accusing him of abuse have already been received by the Council. One of the victims, in fact, is the judge's cousin, who claims to have suffered an attempted sexual crime when he was just 14 years old.


As CNN Brasil found out in February this year, the CNJ Internal Affairs Office is analyzing this and another complaint of sexual harassment against the magistrate. The decision still depends on the progress of the investigation.


If Láuar's guilt is proven, he can be compulsorily retired with proportional salaries - maximum penalty for judges in the administrative sphere.


Accusations and removal
The magistrate's name came to light because he was the rapporteur of the trial that acquitted a 35-year-old man who had a relationship with a 12-year-old girl. In the criminal action, Magid claimed that the child and the subject had "consensual" romantic relationships.

After national and international repercussions - with contrary demonstrations including from the UN -, the Court of Justice of Minas Gerais appealed the decision that had acquitted the defendants. Judge Magid Nauef Lauar himself reviewed the understanding, annulled the acquittal and ordered the arrest of the 35-year-old man, accused of raping a vulnerable person.


Initially, the man and the victim's mother had been acquitted. In his vote, the judge highlighted that the relationship did not result from violence, coercion, fraud or embarrassment, classifying it as a "consensual emotional bond", with the knowledge of those responsible.


However, Public Prosecutor André Ubaldino stated, in a press conference at the time, that the case generated a "sense of indignation" and that the Public Prosecutor's Office appealed the decision through embargoes for clarification - a resource used for the magistrates themselves to review the judgment in the face of possible omissions, contradictions or errors.


The appeal was accepted, and the judge subsequently reviewed the decision.
