CNJ presents proposal to regulate the activities of child influencers

The CNJ (National Council of Justice) presented in this Tuesday's session (9) a proposal that regulates the granting of judicial authorization for children and adolescents to produce artistic or advertising content in digital environments. The proposal provides for safeguards such as preserving children at school and protecting the assets of child influencers.

The working group established by the Council states that, without judicial control, the production of content on social networks becomes guided "exclusively by metrics of engagement and financial return without protective criteria".

Thus, all content that "habitually exploits the image or routine" of children and adolescents will need a license to be broadcast on platforms. The maximum validity of these documents will be 12 months, when referring to children, and 18 months, in the case of teenagers.

Rapporteur of the proposal, counselor Fabio Esteves stated that the proposal for a judicial permit presented "is an instrument to protect the right to not work, a prevention whose assigned responsibility is shared by the State, family, society and digital platforms".

Esteves also said that the "heart of the device" are the safeguards that magistrates can impose when granting the permit, such as guaranteeing the child's permanence at school and "time to play, study, spend time with family and rest".

The instrument also allows the judge to define measures for the asset protection of income generated from activities carried out by children and adolescents.

After presentation, the proposal goes forward to be assessed by the Council. The president of the STF (Supreme Federal Court) and the CNJ, minister Edson Fachin, confirmed that the discussion will take place in the next session of the house, on June 23rd.
