The MPSP (Public Ministry of São Paulo) opened a civil inquiry, last Tuesday (2), to investigate recurrent urban noise pollution on Avenida Paulista, one of the main roads in the capital.


The opening of the investigation takes place after a representation by MovPaulista (Association of Residents, Service Providers and Merchants of Av. Paulista and surrounding areas) regarding noise during the program "Ruas Abertas".


According to the MP, the problem has been occurring for at least 10 years, persistently, in addition to continuous exposure to high levels of noise with sound amplification in artistic performances.

As a response measure to the representation, technical reports and acoustic measurements were gathered, in addition to requesting the municipality, especially the competent Subprefecture and the Secretariats involved, to forward:


- Complete inspection data (infraction notices, reports, schedules);
- Updated operational plan of the Ruas Abertas da Avenida Paulista program; e
- Noise monitoring and control protocols.


According to the MP, "everyone has the right to an ecologically balanced environment", so that there is no discomfort to the well-being, health and safety of the population. Activities and actions considered harmful to the environment are subject to sanctions.

The City of São Paulo established a conciliation commission, but its activities were restricted and were unable to reduce noise to legal standards.


According to the municipal administration, the Open Streets Program, represented by the Residents' Association, expands public spaces for coexistence, leisure and outdoor activities. For the agency, the project encourages qualified occupation of the city, valuing urban spaces and promoting democratic access to leisure activities.


In a note, SMSUB (Municipal Secretariat of Subprefectures) informed that it was notified and will provide the necessary clarifications to the Public Ministry.


CNN Brasil contacted MovPaulista for positioning and is awaiting feedback. The space remains open.


What is the "Open Streets" program
Implemented in 2016 by the City of São Paulo, the project aims to expand public spaces, with more leisure, coexistence and activities options for the population. The action encourages the occupation of public spaces with open roads for pedestrians and cyclists, on Sundays and holidays, in different regions of the city.


According to the municipal administration, the program takes place in two areas in the center: on Avenida Paulista in its entirety; and in four lanes of Liberdade, on the streets of Estudantes, Aflitos, Américo de Campos and Galvão Bueno.


To carry out the action, the roads mentioned do not have vehicle traffic, being signposted by CET (Traffic Engineering Company) and open to pedestrians.


As announced by the city hall on official channels, the Open Streets program may be suspended upon official determination by public security bodies and ordinances.
