Judge José Fernando Steinberg, from the TJSP (São Paulo Court of Justice), ordered the open arrest of journalist Luan Araújo, convicted of defaming former federal deputy Carla Zambelli on the internet.

According to the process, he made a publication in which he stated that the then parliamentarian "is part of a petty, malicious extreme right that is a merchant of death". Upon conviction, the court imposed a fine on Luan that would not have been paid. What motivated the arrest.

"In effect, considering that the convicted person, despite being duly summoned, did not comply with the pecuniary benefit imposed, under the terms of article 44, § 4, of the Penal Code, I convert the sentence restricting rights into a sentence depriving him of liberty, along the lines of the extended sentence", wrote the magistrate in the decision.

The journalist's defense filed a request for habeas corpus alleging that Luan "finds himself in a situation of proven economic hyposufficiency". Because of this, the arrest, according to lawyer José Luiz de Oliveira Junior, who represents him, amounts to a debt prison - prohibited by the legal system.

Luan Araújo is 34 years old and has dedicated much of his career to sports journalism. He was involved in another episode related to the parliamentarian.

In 2022, the day before the elections, he was persecuted by the parliamentarian. Zambelli wielded a gun at the time. The case ended up in the STF (Supreme Federal Court), since the deputy had forum prerogative.
