Disclosure
Following an agreement signed with the Public Ministry of Minas Gerais (MPMG) and the Brazilian Institute for Consumer Protection (Idec), Banco Itaú will have to return to customers amounts unduly charged for uncontracted insurance.
The measure was announced on May 29, 2026 and applies to account holders across the country. If it fails to comply with the agreement, the financial institution may pay a fine of R$10,000 per day for any irregularity committed.

According to the prosecutor's office, the banking institution violated the Consumer Protection Code (CDC) and committed an abusive practice by charging fees without consent between June 13, 2011 and December 18, 2025.

📌 What was decided?
The agreement ends a public civil action filed by the Consumer Protection and Defense Program (Procon) of the MPMG and by Idec against Itaú.
The bank will have to reimburse customers who were charged for insurance without their consent, in addition to adopting transparency, prevention and communication measures about the case.
👤 Who can request reimbursement?
Consumers who:
were charged for uncontracted insurance;
continued to be charged after requesting cancellation are entitled to reimbursement.
📅 The agreement covers undue charges between June 13, 2011 and December 18, 2025.
✅ What are the requirements?
To request the refund of the amounts, it is necessary to meet the following criteria simultaneously:
have evidence of insurance charges that were not contracted or maintained after cancellation;
have filed a complaint by December 18, 2025;
have not previously been reimbursed.

Yes.
Anyone who has suffered an undue charge in the last five years can still:
request cancellation;
request reimbursement;
take legal action, if necessary.
📢 How will customers be notified?
Itaú will have to carry out a national campaign, including:
large circulation newspapers;
the bank's website;
social networks, such as Instagram;
communication to the defense bodies of the consumer.
🗓️ What is the deadline to request the money?
Consumers will have up to two years to request reimbursement, from the start of the campaign provided for in the agreement.

documents that prove the charge;
record of the previous complaint;
bank details for possible refund.

The consumer can choose between:
PIX
TED
deposit

or payment order

The bank must:
require prior authorization;
inform the contract by text message (SMS), WhatsApp or e-mail;
facilitate cancellation;
reverse the amounts after the cancellation.

Itaú will have up to three invoices to make a refund.

A fine of R$ 10 thousand per day and for non-compliance.
