Hidden Carbon: Operation targets new PCC scheme in the fuel sector

The MPSP (Public Ministry of São Paulo) launched this Thursday morning (28) the second phase of Operation Hidden Carbon, called "Operation Hidden Flow", against a new money laundering scheme by the PCC (Primeiro Comando da Capital) in the fuel sector, which also involves fintechs.

59 search and seizure warrants are being executed in the states of São Paulo, Rio de Janeiro, Minas Gerais and Paraná. The action has the participation of the Federal Revenue, ANP (National Petroleum Agency), São Paulo State Finance Department, State Attorney General's Office, Military Police and Civil Police.

Investigations
According to the agency, the objective of the new operation is to advance the fight against fraud, tax evasion and money laundering schemes in the sector. The main focuses this morning (28) are six more fintechs discovered and fuel adulteration using naphtha (solvent).

Investigations indicate that the new companies acted as parallel banks for the PCC.

They were part of a powerful financial nucleus, being used for internal financial compensation between various distributors and gas stations, between companies and investment funds managed by the criminal organization, payments to employees and payments for expenses and personal investments of the main operators.

The MP also indicated that there is a group involved in the diversion of petrochemical naphtha to terminals and gas stations. The work, carried out in conjunction with the ANP (National Petroleum Agency), revealed a robust structure of falsehoods, with simulated sales of solvents to shell companies.

According to the complaint, there was a structure created for the serial opening of companies in the most diverse states in Brazil. The investigations show that those accused used relatives, people in socially vulnerable situations and even prisoners to set up legal entities that allegedly acquired solvents. In practice, they were diverted to Greater São Paulo.

In the identified nucleus, GAECO's investigation with the Federal Revenue Service found that the same asset concealment mechanisms were used as in the other scheme. In addition to payment institutions, financial transactions involved investment funds to disguise the real beneficiaries of the PCC's business.

Scheme funds
Four funds were identified that participated in the scheme and are targets of the operation, along with two asset managers and two managers.

The four funds investigated in the naphtha diversion scheme currently have assets estimated at approximately R$205 million. In just over a year, assets increased by more than 200%.

According to the MP, the structures of the same "marginal financial counter" were used, sharing flow channels and laundering techniques, sometimes funds/fintechs, some of which were already indicated in the first phase of Carbono Oculto and which are now evident again, especially on the naphtha front.
