Federal deputy Alencar Santana (PT-SP), president of the committee that evaluated the 6x1 in the Chamber, sent a letter to the MGI (Ministry of Management and Innovation in Public Services) last Tuesday (26) asking for a reinforcement in the labor tax auditors' team if the PEC that changes the 6x1 scale is implemented.


According to the document, without effective monitoring of the new working hours, there is a risk that the reduction in working hours "exists only on paper, while millions of workers continue to be subjected to the intensification of work and illness caused by excessive hours worked", he explains.


According to data presented in the letter, the government has had a total of 3,664 Labor Auditor-Fiscal positions since the 1990s, of which only 2,680 are occupied today. At the same time, the country's economically active population fell from 55 million to around 108 million.

According to the ILO (International Labor Organization), for every 20 thousand economically active people, there must be an active tax auditor. Based on this calculation, around 5,400 employees would be needed to perform the function.


The parliamentarian's request came from the 2024 General Labor Court Report, prepared by the TST (Superior Labor Court). The document found that the issue "working hours/overtime" is the most recurrent in the Labor Courts.


"It is not enough to just discuss formal changes in legislation or the end of the 6×1 scale: it is necessary to guarantee concrete control and punishment mechanisms for companies that fail to comply with working hours limits, suppress rest breaks or impose abusive overtime", it states in the document.

The issue of informality in the labor market is also highlighted in the text. Using data from Pnad Contínua, a survey carried out by IBGE, Brazil has around 20 million informal wage earners. According to the deputy, inspection plays an essential role for these workers.


"Without an effective presence of the State in the workplace, the end of the 6×1 scale runs the risk of benefiting only the most formalized sectors, leaving millions of people subjected to daily super-exploitation", concludes the document.
