The special committee that discusses the Proposed Amendment to the Constitution (PEC) to reduce working hours in the Chamber of Deputies approved this Wednesday (27) the opinion of the rapporteur, deputy Leo Prates (Republicanos-BA).
The opinion was approved 34 in favor and 4 against. The text still needs to be approved by the plenary before being sent to the Federal Senate. The PEC should be voted on by the plenary this Wednesday.
The deputy's opinion, presented last Monday (25), reduces the working day from 44 to 40 hours per week. (see details of the proposal)
The deputies rejected a highlight presented by the PL for the end of the 6x1 scale to be immediate and not after 60 days after the promulgation of the PEC.
The text also establishes a transition of up to 14 months for the reduction of hours, with a drop of two hours after two months of the promulgation of the PEC.
The proposal could have been voted on on Monday (25), but deputy Maurício Marcon (PL-SP) asked for a review and postponed the analysis.
A PEC is a legislative project that changes the text of the Federal Constitution, the main rule of the Brazilian State. As it requires very strict approval rules - requiring voting in two rounds in both houses of Congress (House and Senate)
The request for review by the special committee is counted in sessions held in the plenary. The deadline is two plenary sessions.
This Tuesday, the Chamber held a session and, on Wednesday morning, before the opening of the special committee, Motta called a new session to beat the minimum deadline.
The session lasted eight minutes and no project was voted on, which shows the commitment of the president of the House to vote on the matter quickly.

With approval by the committee, the opinion goes to the Chamber's plenary, where it will need the support of at least 308 parliamentarians in two rounds of voting.
The regulations establish an interval of five plenary sessions for voting between one round and another, but parliamentarians usually approve a request that waives this period.
The rapid processing of the PEC had the support of the president of the Chamber, Hugo Motta (Republicanos-PB), who scheduled extra sessions in the House to beat the deadline for presenting amendments to the committee.
The special committee discussed two PECs, one authored by deputy Reginaldo Lopes (PT-MG) and another authored by congresswoman Erika Hilton (PSOL-SP).
Both provided for a reduction in working hours to 36 hours, but the final agreement was 40 hours, with two days off per week, one of them preferably on Sundays.

What the text says
The proposal changes part of the Federal Constitution that deals with Fundamental Rights and Guarantees and makes it clear that the "duration of normal work" will not exceed eight hours per day and forty hours per week.
The article provides for exceptions when allowing time compensations and the reduction of working hours in accordance with an agreement or collective labor convention.
According to the proposal, the reduction of four hours in the working day will be implemented in two stages:
the first two hours within two months after the promulgation of the PEC;
the four hours within 12 months after the reduction of the first two hours.
The end of the 6x1 scale, with the guarantee of at least two weekly days off, preferably on Sundays, will come into force 60 days after the text's promulgation.
The transition period was the main point of discussion in the PEC in recent weeks.

Businesspeople and employers' confederations asked for time to adapt to the measure.

The government, at first, was against the transition, but reached an agreement to allow the gradual implementation of the reduction in working hours.
The rapporteur established that, after 60 days of promulgation, all conventions and collective agreements that are incompatible with the new working hours lose validity automatically.
This point will serve as a barrier to force unions and companies to sit at the negotiating table.
The PEC includes in the Constitution the requirement for two paid days off per week, one of them, preferably, on Sundays, and determines that "enjoyment of at least one of the days within the maximum period of a working week must be guaranteed". higher education and who earn from two and a half times the INSS ceiling - approximately R$21,100 currently.
For these professionals, the working hours and time control rules will not apply. The exclusion took place under the argument of combating "pejotization" and giving freedom to high-income professionals.
In the opinion of economists, the debate in the federal government and the National Congress needs to be accompanied by discussions about productivity gains which, according to them, will come mainly with increased worker qualifications, innovation and investments in improvements in infrastructure and logistics.
