This Tuesday (26), the First Panel of the STF (Supreme Federal Court) decided to end compulsory paid retirement as the maximum penalty applicable to judges and ministers.


On the same day, the National Council of Justice (CNJ) and the National Council of the Public Ministry (CNMP) implemented the unification of paychecks for magistrates and members of the Public Ministry into a single document.


In the opinion of political analyst Teo Cury, the movement represents an attempt to contain the deterioration of the image of the Judiciary, especially after the Banco Master case. "The Supreme Court is giving society a response to points that are historically questioned," said Cury on Live CNN this Wednesday (27).

Cury contextualized the financial dimension of how compulsory retirement worked. He explained that the salary ceiling in the Judiciary is around R$46,000, an amount corresponding to the remuneration of a STF minister, and can reach around R$40,000 for other positions.


"Imagine receiving R$30,000 forever, without working, even having committed a crime", he illustrated. Cury also highlighted that this is an old and widely criticized practice, but that it had never been effectively changed until now.


Until then, the current rule provided that a judge convicted of illegal acts could be removed from office and, as the maximum punishment, would receive a lifetime pension funded by the public treasury. With the new decision, magistrates who commit crimes must lose their position and, consequently, their salary.

The decision by the CNJ and CNMP to unify the paycheck seeks to resolve an issue that made it difficult to control and monitor the amounts received.


"How did it work before? There was more than one paycheck. He earned his salary, another paycheck was issued with amounts that he needed to receive retroactively. These payments were decentralized", explained Cury.


These compensation amounts and retroactive payments dispersed in different documents became popularly known as "hangings" and commonly exceeded the ceiling of the magistrate and the Public Prosecutor's Office.


Cury compared these decisions by the STF and CNJ with the "packages of kindness" that governments usually make in an election year: "The Supreme Court is doing this in another way, to try to circumvent this image erosion that was caused by the Banco Master case", he stated.
