The Chamber of Deputies approved a bill that expands and guarantees the rights of people with type 1 diabetes in school and work environments. PL 5868/25, from the Senate, will be sent for presidential sanction.


Among the proposals is the possibility of inclusion in the CIN (National Identity Card) - which replaces the RG (National Registry) - of the condition, in order to facilitate the exercise of the rights provided for or contribute in cases of emergency.


For the rapporteur, deputy João Cury (MDB-SP), the project creates conditions so that people with type 1 diabetes receive adequate treatment and can prevent complications from the disease. "The proposition contributes to removing concrete barriers to the full social participation of these people", said Cury.

The PL classifies a person with type 1 diabetes as a person with a disability, following the criteria established in the Statute of Persons with Disabilities.


According to the text, the granting of financial benefits, such as the Continuous Payment Benefit (BPC), will depend on a specific biopsychosocial assessment for work incapacity or socioeconomic vulnerability.


The project also reinforces the right to medicines within the scope of the SUS (Unified Health System), regardless of biopsychosocial assessment, as well as supplies necessary for the application of insulin and insulin monitoring.

The approved text also guarantees people with type 1 diabetes the possession and use of a glucometer, a continuous glucose monitoring system, insulin, an insulin pump and other supplies necessary for the treatment of the disease, both in educational institutions and in the workplace.


Rights for school-age children
The PL provides for the guarantee of rights for children with type 1 diabetes and their guardians, such as access to nutritional information and the schedule of meals offered at school, in a clear and up-to-date manner. According to the text, these menus must be adapted to nutritional needs and parents or guardians will be able to request that the dishes be offered at flexible eating times.


Another point provided for by the PL is the right of parents and guardians to request adaptation of the working day when it is necessary to monitor the dependent's treatment. To this end, adjustments to schedules, breaks or departures must be made, observing the working hours compensation rules and other applicable labor standards, including collective bargaining agreements and conventions.


What is type 1 diabetes?
Type 1 diabetes is a chronic, non-communicable and hereditary disease, characterized by the destruction of the cells in the pancreas responsible for the production and secretion of insulin. The disease is common in children and adolescents between 10 and 14 years old, although the diagnosis in adults is also recurrent.


According to the Ministry of Health, type 1 diabetes has a high incidence, with 25.6 cases per 100,000 inhabitants each year.


Treatment requires daily use of insulin to regulate blood glucose levels, preventing complications from the disease.
