The CNC (National Confederation of Commerce in Goods, Services and Tourism) criticized, this Tuesday (26), the PEC report that foresees the end of the 6×1 scale.


For the entity, the rules defined can "generate negative impacts on employment, small businesses and the productive capacity of labor-intensive sectors".


The CNC defended that the model presented in the Chamber of Deputies directly affects companies linked to the entity, and criticized the lack of specific rules for sectors such as commerce, tourism and services in general.

"The CNC assesses that the constitutional change, by establishing rigid and uniform parameters, disregards the specificities of trade in goods, services and tourism - sectors marked by seasonality, continuous operation, extended hours and the need for in-person service", it says in a note.


The text of the PEC for the end of the 6×1 scale was presented on Monday night (25) by the rapporteur, deputy Leo Prates (Republicanos-BA), and foresees a two-hour reduction in working hours within 60 days after the publication of the law and the end of the 6×1 model - with the implementation of at least two weekly days off in the same period.


The other two hours of leave would be applied within one year after the law is enacted. The text must be voted on in the special committee for the topic, in the Chamber of Deputies, on Wednesday (27), and go to the plenary session in May.

According to the CNC, the current working hours model already "meets the demands of employees and employers", and changes to the rules should be made through "collective negotiations".


"The current constitutional limitation of 44 hours results from a balance created in the National Constituent Assembly between worker protection and preservation of economic competitiveness", said the CNC.


"Although we recognize the legitimacy of the debate on reducing working hours, we emphasize that directly changing the Constitution may impose relevant additional costs on companies, requiring restructuring of schedules, review of contracts and operational reorganization", added the Confederation.

Small businesses
The CNC also argued that the end of the 6×1 scale will have even more significant impacts on micro and small companies.


According to the entity, such businesses have less capacity to absorb "abrupt increases in costs".


"This scenario tends to pressure margins, reduce investments and affect the generation and maintenance of formal jobs, especially in labor-intensive activities", stated the CNC.


The opinion also mentions the possible loss of strength of in-person commerce in relation to online sales systems.


According to the entity, if physical costs rise, there may be "acceleration of the migration process to digital and automated models".
