Opposition parliamentarians in the National Congress have articulated strategies to try to modify the PEC at the end of the 6×1 scale. The group's main bet is to include in the text a proposal for payment per hour worked, as an alternative to the fixed working day model currently under discussion.


The investigation is by CNN political analysts Julliana Lopes and Pedro Venceslau at Hora H.


Opposition strategy
According to Julliana, the opposition's first movement was the request for a review made by deputy Maurício Marcon (PL) who postponed the vote in the special committee, initially expected last week.

With this time gained, the expectation now is for approval by the commission the day after the investigation, with a vote in plenary scheduled for May 28th.


The opposition intends to use this interval to convince senators to include new points in the text.


The proposal defended by the opposition provides that the worker has the option of choosing payment per hour worked, defining, in negotiation with the employer, what his own working hours and the hourly rate would be.

According to Julliana Lopes, the idea is to include this possibility as an amendment during the plenary discussion, at least for some categories, and at the same time take the debate to the Senate.


"The idea is that, instead of discussing working hours, the worker has the option of choosing payment per hour worked", explained the analyst.


The proposal for payment per hour worked is rejected by the PT and the unions, who understand that the model would weaken labor relations in Brazil.


Still, the opposition insists on the strategy, aware that directly opposing the end of the 6×1 scale is politically costly.


"Treating the PEC in a contrary way, the end of the 6×1 scale, is very unpopular for opposition parliamentarians", highlighted the analyst.


Essential sectors and negotiation by category
According to Venceslau, another point of attention involves the so-called essential sectors.


The rapporteur, deputy Leo Prates (Republicanos-BA), would be evaluating an opinion that suggests the removal of sectors such as health, food, aviation, security and public transport from the scope of the reduction in working hours, under the argument that these areas would not be able to adapt to the new rules.


If the opinion is accepted and included in the PEC, these sectors would be excluded from the measure.


Guilherme Boulos (PSOL), Secretary General of the Presidency, consulted on the topic, argued that this debate should not take place through the PEC, as it is not a constitutional matter.


According to him, any specific regulations should be made through a government PL.


Boulos stated that negotiations will take place on a case-by-case basis, category by category, citing as an example oil workers, who work 15 days on board and spend 15 days at home, and health professionals, who work long shifts.


The need to negotiate sector by sector, according to the investigation, also reflects the government's concern with possible questions in the STF (Supreme Federal Court).
