Judge who allegedly sold decision for quadricycle is investigated in PR

The Paraná section of the OAB (Brazilian Bar Association) requested the removal of judge Francisco Carlos Jorge, from the state Court of Justice, on suspicion of selling judicial decisions in exchange for a quadricycle.

According to the Order's request, the judge would have received the vehicle - valued at around R$62,500 - in exchange for a favorable sentence for one of the parties in a legal dispute over rental charges, which has existed since 1993.

According to the document, the magistrate, in a public note, denied the accusations and described the intelligence report that found the irregularities as "of dubious origin". Furthermore, the judge pointed out that the vehicle was acquired by the son and the action would not constitute an "undue advantage".

The request made to the CNJ (National Council of Justice) also maintains that the charges attributed to the magistrate are of the "maximum gravity", and mentions that, in March of this year, the magistrate had failed to comply with an administrative determination from the court itself that suspended the professional's performance in processes related to the case.

"The Judge, however, directly and documentedly ignored the suspension order, remaining in the rapporteur and carrying out jurisdictional acts subsequent to the decision - conduct that projects the effects of the contested act on all processes conducted by him after that date", highlighted the document.

In view of the situation, the OAB initiated a preventive suspension procedure in relation to two lawyers involved in the case, which will be analyzed in the next session of the Special Chamber of the Ethics and Disciplinary Court, next month.

To support the request, the OAB even cited recent precedents, when the removal of other judges from the Court of Justice of Paraná was determined during disciplinary investigations.

According to the document, if the CNJ does not accept Francisco's full removal, the entity requested the "compulsory redistribution" of all processes under the magistrate's report and that are related to the case.

CNN Brasil contacted the Civil Police of Paraná to understand whether a police investigation into the case has already been opened. CNN Brasil is also seeking contact with the judge's defense and the space remains open for demonstrations.
